Welcome to Tuckly. These Terms of Service govern your use of the Tuckly application and services. By accessing or using Tuckly, you agree to be bound by these terms. Please read them carefully before using our service.

Acceptance of Terms

By downloading, installing, or using the Tuckly application, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

Description of Service

Tuckly is an AI-powered personalized bedtime story application designed for children. The service allows parents and guardians to create customized bedtime stories tailored to their child's name, age, interests, and reading level. All accounts and child profiles are created and managed by parents or legal guardians.

Account Registration

To use Tuckly, you must create an account. By registering, you agree to the following:

• You must be at least 18 years of age to create an account
• You are responsible for maintaining the security and confidentiality of your account credentials
• Only one account is permitted per person
• You are responsible for all activity that occurs under your account

Subscription and Billing

Tuckly offers the following subscription options:

Free Tier

• Up to 3 stories per day
• Access to all features

Tuckly Plus

• $4.99 per month or $39.99 per year
• Unlimited story creation and premium features

Billing Terms

• All payments are processed securely through Apple's in-app purchase system
• Subscriptions automatically renew until cancelled through your Apple ID settings
• You may cancel your subscription at any time via your iPhone Settings → Apple ID → Subscriptions; access will continue until the end of your current billing period
• Refunds are handled by Apple in accordance with their refund policy

User Content and Data

• You retain ownership of the child profiles and preferences you create within the app
• Stories generated by AI are provided for personal, non-commercial use only
• You may save and share stories with family members
• We may use anonymized, aggregated data to improve our service

Acceptable Use

When using Tuckly, you agree to:

• Use the app for its intended purpose of creating children's bedtime stories
• Not attempt to reverse-engineer, exploit, or misuse the service
• Not create accounts for fraudulent purposes

We reserve the right to suspend or terminate accounts that violate these terms.

AI-Generated Content

Tuckly uses artificial intelligence to generate personalized stories. Please be aware of the following:

• Stories are generated by artificial intelligence and may occasionally contain unexpected content
• We implement safety filters to ensure age-appropriate content, but we cannot guarantee that all generated content will be suitable for every child
• Parents and guardians should review stories before reading them to children
• We are not liable for AI-generated content

Intellectual Property

• The Tuckly brand, design, and technology are our exclusive property
• AI-generated stories are provided under a personal use license and may not be used for commercial purposes

Limitation of Liability

• The service is provided "as is" and "as available" without warranties of any kind, either express or implied
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service
• Our total liability is limited to the amount you have paid to Tuckly in the 12 months preceding the claim

Termination

• You may delete your account at any time through the app or by contacting support
• We may terminate or suspend accounts that violate these Terms of Service
• Story data stored locally on your device will remain on your device after account deletion

Changes to Terms

We may update these Terms of Service from time to time. When we make significant changes, we will notify users through the app or via email. Your continued use of Tuckly after any changes constitutes your acceptance of the updated terms.

Governing Law

These Terms of Service are governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the service will be resolved in accordance with applicable legal procedures.
